In a precedential decision, the district court held that it is possible to file a class action seeking compensation for morbidity which was caused by mass exposure to pollution. It was further held that the public interest requires a discussion regarding the liability of entities who emit pollutants, to excess morbidity, and that if such liability will be imposed, the class members should be compensated.
